16. Class Action Waiver

You and cipher agree that any claim brought against the other will only be brought in an individual capacity. Neither you or cipher are entitled to bring a claim as a class, consolidated, representative, or private attorney-general action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

At CIPHER’s sole discretion, it may require You to submit any disputes arising from the use of these Terms of Use or the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying FLORIDA law.
